Terms of Service

Last Updated: November 6, 2024.Please read these Terms Of Service ("Terms", "Commission TOS", "Terms of Service") carefully before commissioning me (the "Service") operated by Charlie Berkoff @bananahhhhh on Twitter or #.charlibarli on Discord ("I", "me", "my", or "the artist"). Commissioners understand and agree to these conditions upon commissioning me.

DEFINITIONS1. the Commission refers to the order for or authorization of the production of (something such as a building, piece of equipment, or work of art).
2. the Commissioner (you) is an individual who has been given a commission or who has given the order for the production of work by the artist.
3. an Invoice is a list of goods sent or services provided, with a statement of the sum due for these; a bill.
4. a WIP or Work In Progress is an unfinished project that is still being added to or developed (which is often provided in the form of a photograph in this context).PAYMENT & REFUNDSAll payments must be made via PayPal invoicing. There are no due date on invoices, but reminders will be sent after the first 7 days within receiving the invoice.
I will not start on a commission until at least 50% of a commission is paid.
I require full payment before finishing commissions under $50.
Possible fees will be discussed and added before the invoice is sent.
I promise to share progress and update you frequently on your commission in the form of sketches and screenshots (I will often refer to these as WIPs or Work In Progress).NOTE: Refunds can be requested at any time during the commission process. Refunds will not be issued after the commission has been completed. Full refunds are issued only before the start of work on a commission.If a commission is being cancelled during actual creation process refunds will be calculated depending on the amount of work completed.Please do not be afraid of contacting me if you have any questions or I have not updated you within five days since accepting and starting your commission. You can also contact me about receiving a refund using information from here as well.

EDITS & CHANGESI encourage commissioners to communicate with me during the creative process so that they are fully satisfied with their finished piece upon completion! However, in the event that you wish a slight change to be made, (ex. colour adjustments, adding something to a character sheet, etc.) please read the information below.Remember that commissioners are not to edit illustrations unless given explicit written permission to do so.If you are not satisfied with an aspect of your commission and wish to have this corrected or changed you have 10 (ten) business days (not including holidays or scheduled off days) to contact me and:request the change to be made by me (may be subject to a fee if the change is considerable)
request permission to make the change yourself (depending on the change, you may not be able to receive permission from me to do so)

OTHER TERMS & CONDITIONSCommissioners understand that I remain the right to use a commission for promotional uses (ex. using your commission as an example on my website).You are NOT to remove the signature I place on a commission (unless given permission by me, and the image is linked back to my website/social media).
You are NOT to edit the work I’ve done for you unless given permission specifically by me, the artist. (Ex. changing colours, adding/subtracting visuals from the piece, cropping the piece in any way, tracing over the piece).
You are NOT to use my work for AI learning or AI art.
YOU ARE NOT TO SELL OR USE MY WORK FOR PROFIT (Ex. as digital/physical prints, post cards, stickers, NFTs, etc) unless an agreement has been made between us. In the case of this, a separate set of terms will be discussed individually.As a condition of use, the commissioner (you) promises not to use the commission for any purpose that is unlawful or prohibited by these Terms. Additionally, by way of example, and not as a limitation, you agree not to use my services to commission something that:abuses, harasses, threatens, impersonates, or intimidates any person or marginalized group.
content that is defamatory, obscene, abusive, profane, or that infringes copyright or other right of any person
illegal content (e.g. pedophilia, sexual abuse)Reminder: refunds are available+. However, a refund is not available to those who have received a finished piece. I request that payments be made in full before I present the finished product to a client.+If payment is cancelled without informing me you will have lost rights to the work I have done for you since it is not paid for. I reserve the right to edit it as I wish and post it and/or sell it. Please understand that I will erase the existing character and modify the image. I will never claim your character or intellectual property as my own.If a commissioner refuses to comply or breaks terms and conditions set in place, future service WILL BE TERMINATED and refunds will not be issued.
